Naghain ng apela ang Television and Production Exponents Inc. (TAPE) sa Intellectual Property Office of the Philippines (IPOPHL) para mabaliktad ang nauna nang desisyon ng Bureau of Legal Affairs (BLA) na nagkansela ng registration ng producer para sa trademark na “Eat Bulaga.”
Sa desisyong inilabas noong Dec. 4, pinagbigyan ni BLA Adjudication Officer Josephine Alon ang petisyon nina Tito at Vic Sotto, at Joey de Leon, kilala bilang TVJ, na ipa-kansela ang registration ng TAPE para sa trademarks na “Eat Bulaga” at “EB.”
“Wherefore, premises considered, the instant Petition for Cancellation is hereby granted. Accordingly, Certificate of Registration No. 4-2011-005951 issued on 14 June 2013 for the trademark [Eat Bulaga]…is hereby cancelled,” nakasaad sa desisyon ni Alon.
Ang apela ng TAPE ay nai-file na sa director ng BLA kahapon, Dec. 12.
Sa press conference kaninang umaga, Dec. 13, sinabi ng spokesperson at legal counsel ng TAPE na si Atty. Maggie Abraham-Garduque na hindi pa final ang desisyon ng BLA officer.
“This just means hindi pa po pinal ang decision ng adjudication officer ng BLA,” aniya.
Noong Dec. 6, naglabas ng pahayag ang IPOPHL kung saan sinabi nitong “the decisions of the Adjudication Officer may be appealed to the BLA Director within 15 days from receipt of the decisions.
“In turn, the appellate decisions of the BLA Director may be appealed to the IPOPHL Director General within 30 days from receipt of the copy of the BLA Director’s decisions.
“The EAT BULAGA and EB registrations that are covered by TM Reg. No. 4-2011-005951 and No. 4-2011-005950 are for Nice Classes 16, 18, 21 and 25.”
Dagdag ng abogado ng TAPE, “Pagbigyan naman po natin yung apela din na maakyat at marinig din at huwag po natin i-preempt ang decision ng body na magre-review or magtitingin ulit nitong desisyon ng adjudication officer.”
Sinabi niyang dahil hindi pa pinal ang desisyon ng adjudication officer, hindi pa dapat i-implement ang kanselasyon ng “Eat Bulaga” at “EB” trademarks ng TAPE.
Sinabi rin ni Atty. Maggie na sa oras ng press conference kanina, valid pa ang trademark registration ng TAPE para sa “Eat Bulaga” at “EB” ayon sa impormasyon mula sa IPOPHL website.
Samantala, nanatiling pending pa rin ang application ni Joey de Leon para sa trademark na “Eat Bulaga” ayon sa IPOPHL website.
“As of now, we still have the registration of the trademark of ‘Eat Bulaga’ as can be seen from the website of the IPO.
“There is still no award being given to Joey de Leon with regards to the trademark registration of ‘Eat Bulaga’ trademark,” ani Atty. Maggie.
Sinabi rin niya na itutuloy pa rin ng TAPE ang paggamit sa pamagat na “Eat Bulaga” para kanilang noontime show habang pending pa ang kanilang apela.
Sa kanilang apela, hinihiling ng TAPE sa BLA director na ipatigil ang kanselasyon ng registration ng “Eat Bulaga,” baliktarin ang desisyon ng adjudication officer, at ipa-dismiss o ipa-basura ang petisyon ng TVJ na ipa-kansela ang kanilang trademark dahil sa lack of merit.
Pinagdiinan din niya na nirerespeto ng TAPE ang proseso kaugnay sa desisyon ng BLA.
