Nilinaw ng Intellectual Property Office of the Philippines (IPOPHL) noong Huwebes na maaari pa ring gamitin ng Television and Production Exponents Inc. (TAPE) ang pangalang “Eat Bulaga” or “EB” kahit na naglabas ang ahensya ng desisyon na pumanig sa entertainment trio nina Tito, Vic, at Joey sa kanilang desisyong ipakansela ang trademark registration ng naturang noontime show.
Taliwas ito sa proklamasyon ng mga dating host na sina Vicente “Tito” at Vic Sotto, at Joey de Leon, na nagwagi na raw umano sila sa trademark suit laban sa mga producer ng “Eat Bulaga.”
Sa desisyong inilabas noong December 4, ipinasya ng IPOPHL na ang trio ang may-ari ng trademark na “Eat Bulaga” trademark, na nagbibigay bigat sa mga testimonya at paliwanag na ibinigay ng magkapatid na Sotto at ni De Leon.
“The petitioners proved that they were the originator and owner of the contested Eat Bulaga trademark. Petitioners’ explanation or story on how the idea for the Eat Bulaga trademark initially came about did seem believable and credible,” nakasaad sa desisyon.
Sa panayam sa kaniya ng mga reporter, sinabi ng director general ng IPOPHL na si Atty. Rowel Barba na, “Until and unless the decision is decided by the Supreme Court, it is not yet final and executory.
“The winning party can still file an appeal with the IPOPHL-Bureau of Legal Affairs to execute our decision.
“But it is not automatic that the decision is executory.
“At the end of the day, there is this status quo (on the use of the name) unless TVJ files an appeal to execute our decision.
“Under our procedure, appeals should be received by the adjudication officer, the IPOPHL director of legal affairs, the director general, the Court of Appeals, and then the Supreme Court,” ani Barba.
Sinabi ni Barba na nais nilang ma-settle ang kaso sa lalong madaling panahon.
“We based our decision on the rule of ARTA (Anti-Red Tape Authority).
“If they (both parties) file appeals, then we can make a decision in 40 days.
“Usually, before a decision, we ask both parties to submit position papers, then we release the memorandum.
“Once all of this is done, then we will decide,” dagdag ni Barba.
Sinabi ng legal counsel ng TAPE INC. na si Atty. Maggie Abraham-Garduque na malugod niyang tinatanggap ang paglilinaw ng IPOPHL.
Ayon sa IPOPHL, maaari pa ring gamitin ng TAPE Inc. ang pamagat na 'Eat Bulaga' sa kanilang programa dahil hindi pa raw pinal ang desisyon ng adjudication officer ng BLA-IPOPHL at maaari pa itong i-apela.
“This has been our stand from the start, following the rules and procedures of IPOPHL. In effect, this legitimizes the continuous use of TAPE Inc. of the name of Eat Bulaga,” ani Abraham-Garduque.
“I also hope that with this statement of the IPOPHL, TVJ will respect it and will not use Eat Bulaga in their show.”
